The safe purchase of an apartment depends on the connection of the contract, payment of the price, and registration of ownership. The buyer needs to know under what conditions he will pay, and the seller needs to know when he will receive the money. Before booking, it is worth checking the legal status of the apartment and the actual financing procedure.

What to check before booking

Start with an up-to-date extract from the Slovak land register (list vlastníctva). Check the owner, the precise identification of the apartment and shares, liens, easements, annotations and notices of pending cadastral proceedings (plomby). A plomba indicates pending proceedings concerning cadastral entries; establish what those proceedings concern. Also check the data before other significant steps in the transaction, as the situation may change between inspection and signature. [2] [4]

Request the seller's title deed, details about the house management, and an explanation of who uses the apartment. Verify whether the basement, parking space, or share in the land is being transferred along with the apartment, or if there is another legal entitlement. The designation in the advertisement may not be sufficient for the precise formulation of the contract.

Read the reservation agreement to establish who receives the money, what payment it will be credited against and when it must be refunded. Consider in particular the situation where the bank does not provide a loan or a legal obstacle to the transfer arises. Ask for clear terms and conditions before sending the reservation fee.

What must a sales contract address?

Transfer of ownership of an apartment requires a written contract with specific requirements. Besides the parties and the price, the contract identifies the apartment, its appurtenances and fittings, the relevant co-ownership shares, the common parts and facilities of the building, and rights to the land. Also included is a declaration by the purchaser about joining the relevant house or community management agreement. [3]

In the case of a regular further transfer of an apartment, a confirmation from the administrator or chairman of the community is attached stating that the seller has no outstanding arrears related to the use of the apartment and the operation, maintenance and repair fund. The law provides for an exception for the first transfer. However, confirmation does not replace the review of other legal and technical issues. [3]

The contract should also clearly regulate known defects, handover, equipment left in the apartment, costs, and cooperation with the cadastre. If mortgage financing is involved, compare the purchase contract with the conditions for drawing down the loan. A discrepancy between the payment term in the contract and the bank's requirements can block even an otherwise agreed transaction.

How to link payment of price to acquisition of ownership

In a contractual transfer, ownership of real estate is generally acquired through registration in the Slovak cadastre. Therefore, signing the contract alone does not yet secure ownership rights for the buyer. For this reason, it is necessary to precisely set when and under what conditions the price will be available to the seller. [1] [2]

One option is to escrow the purchase price, which can be prepared under agreed terms. The escrow agreement must specify which document proves that the conditions for releasing funds have been met, which encumbrances may remain registered and what happens if registration of ownership is refused. The escrow terms must align with the purchase agreement and any loan financing. [4]

Model example: the apartment is encumbered by the seller's mortgage. Part of the purchase price is to repay the seller’s loan; the remainder will be released under the agreed procedure. Before signing, the parties will request from the bank the quantification and conditions for the cancellation of the lien. A general promise by the seller to settle the mortgage upon receipt of the full price is not sufficient.

What is an application for registration of ownership?

The application for registration is submitted to the cadastral department of the competent district office. The contract and the documents required by law must be attached to the application. After filing, the conditions for registration are examined; neither filing the application nor entering a plomba means that the transfer has been approved. [2] [4] [5]

The basic decision period is 30 days. For a contract in the form of a notarial deed or authorized by a lawyer, it may take 20 days if the legal conditions are met. Upon request and the appropriate fee, expedited processing is possible within 15 days. Defects in the application or suspension of proceedings may affect progress, so these periods should not be treated as an unconditional guarantee of the moving date. [2] [5]

If the cadastre requests an addition, check the exact content and deadline of the invitation and coordinate the response of all parties involved. The contract should also consider cooperation in correcting a removable error. The difference is between a technical defect and a fundamental problem with the seller's ownership rights.

Document the handover of the apartment

The handover protocol should record the date, meter status, number of keys, device status and any deficiencies found. Attach photos and agree on who will ensure communication with the administrator and energy suppliers. If there is furniture or appliances left in the apartment, make a specific list. This avoids disputes over whether an item was included in the purchase price.

Before releasing the relevant part of the price, check that the conditions you have agreed upon have been met. Keep contracts, payment receipts, cadastral decisions and protocols in one place. In the event of a later problem, what was actually agreed upon and delivered will be decisive, not just the original description in the advertisement.

Frequently Asked Questions

Am I the owner of the apartment after signing the contract?
Not in a normal contractual transfer. Ownership arises through registration in the cadastre on the basis of a final decision approving that registration. [1] [2]

Is a bank lien always a reason to refuse a purchase?
The registration itself does not preclude the purchase from being made. However, it is necessary to prepare and coordinate the repayment of the loan, the cancellation of the lien, and the payment of the price in advance. The specific procedure also depends on the bank.

Does a plomba guarantee a successful transfer of ownership?
No. A plomba indicates pending proceedings concerning cadastral entries. It may relate to registration of a right (vklad), a declaratory entry (záznam), correction of an error or a prosecutor’s protest; it does not itself confirm that ownership will be transferred. [2] [4]
