Dividing marital property in Slovakia: the three-year limit
Legal status as of November 1, 2026
Divorce will resolve the personal status of the spouses, but joint property requires further attention. When settling BSM, the correct inventory of assets, the origin of the money, and compliance with the three-year period are decisive. If a mortgage is part of the situation, the relationship with the bank must also be addressed separately.
First establish when the spouses’ community property regime (BSM) ended
The joint ownership of spouses generally ceases upon the finality of the divorce judgment. However, it may cease to exist during the marriage, for example, based on a court decision under legal conditions. Therefore, before calculating the period, check whether its regime has not changed earlier in your case. The date of moving out or the date of filing for divorce is not, in itself, the decisive date of termination. [1]
Have the final judgment, any decision ending BSM earlier, and notarial deeds concerning its scope ready. These documents set the basis for further work. Without them, even a carefully prepared list of assets may be based on the wrong period.
What to include in an inventory of assets
The basis of BSM is property acquired during the marriage, but the law recognizes exceptions, in particular inheritance, donation, or items serving the personal needs or profession of only one spouse. Property owned before marriage generally remains exclusive. For a specific item, it is necessary to assess not only the date of acquisition, but also the method of acquisition and the source of money used. [1]
Divide the inventory by items: real estate, vehicles, equipment, savings, investments, and any business assets. For each, note the proof of acquisition, the estimated value, the person using the item, and the existing dispute. Record debts, instalments paid after divorce and contributions from separate funds to community property, or vice versa, separately.
The settlement may also include related claims and debts in a broader sense. This does not mean that every obligation signed by one spouse during the marriage automatically becomes a joint obligation of both towards the creditor. It is necessary to distinguish between the content of the contract and the mutual settlement of former spouses. [1] [2]
Three years must be monitored even during negotiations
If the BSM is not settled by agreement and a motion for judicial settlement is not filed within three years of its dissolution, statutory rules will apply. For some movable property, exclusive use for personal, family and household purposes is decisive. Other movable and immovable property will pass into joint ownership with equal shares; other common property rights will also be resolved accordingly. [1] [2]
The court does not have to decide within three years. It is essential to file the court application in time. Ongoing phone calls, the exchange of draft agreements, or a promise from the other party do not in themselves replace the necessary legal action. Therefore, before the deadline expires, evaluate whether an agreement is actually achievable and whether it is necessary to file a lawsuit. [1] [2]
When resolving a lawsuit, pay attention to which items should become the subject of the proceedings in a timely manner. A general requirement to divide everything without identifying the assets may create further conflict. An inventory with attachments and marking of items for which evidence still needs to be provided will be of practical help. [2]
An equal division of property is the starting point
The settlement is based on equality of shares. However, contributions from exclusive property, the needs of minor children, care for the family, and contributions to the acquisition and maintenance of common property are also taken into account. Housework and childcare are relevant; therefore, lower labor income does not in itself mean a lower share. [1]
Model example: one spouse invested money received through inheritance in the purchase of a joint apartment. Before negotiations, obtain the inheritance decision and bank records tracing the funds through to payment of the purchase price. Such coherent documentation will explain the origin of the investment better than simply claiming that he contributed more to the apartment. The specific settlement depends on the entire property situation.
Deal with your apartment and mortgage in relation to each other
If both spouses were co-debtors, an agreement that only one spouse will continue to pay the loan does not in itself release the other spouse from the loan agreement. Changing debtors must be agreed with the bank. The bank will assess whether the remaining borrower can handle the loan and determine the terms of the modification. [1] [3]
When negotiating, first determine the loan balance and the realistic possibilities for financing the settlement share. Then coordinate ownership of the apartment, loan repayments, the deadline for paying the other spouse and the handover of the property. If neither of you can keep the apartment, a practical option may be to sell it and agree on a division of the net proceeds.
An agreement regarding real estate must be in writing and becomes effective upon entry into the land register. Allow sufficient time for signing, applying for registration in the land register and meeting the three-year deadline. [1]
How to recognize a ready-made agreement
Before signing, make sure everyone understands the end result. The agreement should precisely identify the property, the amount and maturity of the settlement, the method of transfer, and cooperation in the necessary registrations. If payment is to be made in installments, also consider security and the procedure in case of non-payment. Don't leave unresolved issues hidden in a general sentence that the parties have settled everything.
Frequently Asked Questions
Must the court make a decision within three years of the divorce?
No. If settlement by agreement is not achieved in time, an application for judicial settlement must be filed within three years. [1]
Is our agreement enough for the bank to release me from the mortgage?
No. Changing debtors requires the bank's consent and the appropriate adjustment of the credit relationship. [1] [3]
Does the passage of three years mean the loss of all property?
No. Legal settlement rules will come into play, but they may lead to a different outcome than the intended agreement or court settlement. [1] [2]
If you are dealing with property after a divorce, prepare a judgment, an inventory of property, and loan agreements. We will help you assess the agreement and the necessary steps before the deadline expires.
